These Terms govern your use of FormFeed, a form-backend service operated by Internection LLC, 54 Farrand Drive, Parsippany, NJ 07054 ("we", "us", "Company"). By creating an account or using the service you agree to these Terms. If you don't agree, don't use the service.

1. The service

FormFeed accepts HTTP form submissions on your behalf, stores them, and forwards them to you by email. You provide the form endpoint URL on your site; visitors submit to it; we deliver the submission to the notification email you configured.

The service is under active development. Features may change over time; we'll communicate material changes through the service or by email.

2. Your account

You must verify your email address to use the service. You're responsible for keeping your login credentials secure and for all activity under your account. You must be at least 13 years old to use the service.

3. Acceptable use

You agree not to:

• Collect submissions in ways that violate applicable law
• Use the service to send unsolicited email (spam)
• Share or resell your account credentials
• Submit malware, phishing content, or illegal material through forms you own
• Attempt to probe, scan, or test the vulnerability of any FormFeed system, breach security or authentication measures, or circumvent any technical measure protecting the service
• Reverse-engineer, decompile, or disassemble the service or attempt to extract source code
• Scrape, crawl, or harvest data from the service or bypass robots.txt or rate-limiting controls
• Frame, mirror, or repackage the service or use Internection or FormFeed trademarks without our written consent
• Make automated use of the service that imposes a disproportionate load on our infrastructure
• Forge headers or otherwise transmit deceptive source-identifying information
• Use the service to harass, abuse, or harm any person or group
• Impersonate any person or misrepresent your affiliation with any person or entity
• Use the service for the benefit of any third party except as permitted by these Terms (no resale, sublicense, lease, or assignment)
• Encourage or enable any other party to do any of the foregoing

We may suspend or terminate accounts that violate these rules, with or without notice, particularly where doing so protects other customers or the health of our sending reputation.

4. Subscriptions and billing

Paid plans require a valid payment method, processed by Stripe (our billing service provider). Billing runs on either a monthly or annual cycle depending on the plan you pick. New subscriptions include a 14-day free trial; your card is not charged until the trial ends, and you can cancel anytime during the trial at no cost.

You represent that the payment information you provide is true and that you are authorized to use the payment method. You agree to keep your billing information current.

Subscriptions renew automatically at the end of each billing period unless canceled. There are two ways to end a subscription, and the refund treatment differs:

• Cancel via the billing portal (linked from your Billing page). Your subscription stays active until the end of the current billing period and then stops renewing. We do not refund the remainder of the period.
• Delete your account entirely (from your Account page). This cancels your subscription immediately and issues a prorated refund for the unused portion of the current billing period, via Stripe to the card on file.

Annual plan downgrades take effect at the end of the current period.

If you dispute any charge, you must notify us within thirty (30) days of the date you were billed. We may change our fees on at least 14 days' notice (posted to the site or sent by email); continued use after the change takes effect constitutes acceptance.

Plan limits (number of forms, submissions per month, daily caps) are described on our pricing page and enforced by the service. If you hit a limit, submissions past the cap will be rejected until the next billing period or until you upgrade.

5. Your data and our data

Submissions sent to your forms belong to you. We store them on your behalf, deliver them to you, and don't use them for our own purposes. You're responsible for what your forms collect and how you use it — including any privacy notices your own site provides to its visitors.

The FormFeed software, website, brand, and documentation are our property. You may use the service while subscribed; nothing in these Terms transfers ownership of our intellectual property to you. We reserve all rights not expressly granted.

Our Privacy Policy explains what we collect and how we use it.

7. Feedback

If you send us feedback, suggestions, or ideas about the service ("Feedback"), you grant us a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sublicensable, and transferable license to use, modify, and incorporate the Feedback into our products and services for any purpose. You don't have to provide Feedback, but if you do, we want to be free to use it.

8. Termination

You can delete your account anytime from your Account page. We retain your data for 30 days after deletion in case you change your mind; after 30 days it's permanently deleted. If your subscription is canceled, your dashboard remains accessible for 90 days for data export, after which stored submissions are purged.

We may terminate your account for breach of these Terms, non-payment, or legal reasons, giving you reasonable notice where practical.

9. Electronic communications

By signing up you agree to receive transactional and account communications electronically (account verification, billing notices, security alerts, service announcements). These satisfy any legal requirement that such communications be in writing.

10. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EVERY SUBMISSION WILL DELIVER (EMAIL CAN FAIL AT THE RECIPIENT'S END). YOU USE THE SERVICE AT YOUR OWN RISK.

Some jurisdictions do not allow disclaimers of warranties, so this section may not apply in full.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE FEES YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

Some jurisdictions do not allow these limitations, so this section may not apply in full.

12. Indemnification

You agree to indemnify, defend, and hold harmless Internection LLC and its affiliates, officers, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) the content of forms you operate or submissions you process; (c) your violation of these Terms or applicable law; or (d) claims from your site's visitors relating to data they submitted.

13. Dispute resolution; arbitration; class waiver

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or the service shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in New Jersey. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and we agree that arbitration shall be conducted on an individual basis only. Neither party may bring claims as a plaintiff or class member in a class, consolidated, or representative action, and the arbitrator may not consolidate claims of more than one person.

Time limitation. Any claim must be brought within one (1) year after the cause of action accrues; otherwise the claim is permanently barred, except where applicable law prohibits this limit.

Attorneys' fees. If a party brings legal action arising out of these Terms or the service and does not prevail, that party will reimburse the prevailing party's reasonable attorneys' fees and costs, except where prohibited by law.

This section does not prevent either party from seeking emergency or injunctive relief in court for urgent matters.

14. Governing law and venue

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-laws principles. To the extent any claim is not subject to arbitration, the state and federal courts located in New Jersey have exclusive jurisdiction, and you consent to that jurisdiction.

15. Assignment

We may assign these Terms in whole or in part, including in connection with a merger, acquisition, or sale of assets. You may not assign these Terms without our prior written consent; any unauthorized assignment is void.

16. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of our right to enforce it later. These Terms, together with the Privacy Policy, are the complete agreement between us regarding the service and supersede any prior agreement on the same subject.

17. Changes

We may update these Terms. When we make material changes we'll email active subscribers and update the "Last updated" date above. Continuing to use the service after changes take effect means you accept the updated Terms.

18. Notice for California users

Under California Civil Code Section 1789.3, California users are entitled to the following notice: current rates for the service are available at https://formfeed.io.
